Are Your Assets Protected?
I was at Busch Gardens this weekend relaxing and I had a huge reminder. Imagine that its Monday morning and there's a knock on your office door. You answer it with "Can I help you?" and the person asks with a BIG smile "Are you 'so and so'. And you say "yes" expecting to receive the Publisher's Clearinghouse award or something.
Instead he serves you with legal papers, mutters some words like "you've been served" and turns and walks away.
After you catch your breath, you jump in the car and head to your lawyer's office. You regain control of your thoughts by remembering that between your corporation and your insurance, you're pretty well protected. By the time you arrive at his office, you've regained your composure.
You explain the situation to your lawyer (something about a car accident your kid had or an uppity tenant that you evicted because he was playing his electric guitar at 3 a.m. and disturbing the neighbors). Then, you say (a bit wishfully) " But I'm sure everything's gonna be ok between my corporation and my insurance, - right?
The lawyer looks up and with a stern, concerned look on your face says "I'm afraid its not that simple. You've got some potential liability here." Your worst nightmare has just begun.
The only thing worse than leaving yourself unprotected (i.e. with a sole proprietorship or general partnership) is having a false sense of security. In other words THINKING that you've got all your asset protected when in fact you don't. The problem is that once the lawsuit hits, its too late to do anything about it.
